Clause 15 of the Law of Ukraine “On the Legal Status of Foreign Nationals and Stateless Persons”
Documents for foreign nationals and stateless persons to enter and/or exit Ukraine
- The following requirements apply for entering and/or exiting Ukraine:
- for foreign nationals and stateless persons – a passport document with an appropriate visa, unless a different entry/exit procedure is stipulated by the laws or international treaties of Ukraine;
- for foreign nationals permanently residing in the territory of Ukraine – a passport document and a permanent residence card;
- for stateless persons permanently residing in the territory of Ukraine – a stateless person’s international travel ID;
- for foreign nationals and stateless persons recognised as refugees in Ukraine or persons in need of special protection in Ukraine – a travel document for international travel;
- for foreign nationals and stateless persons married to Ukrainian citizens – a passport document and a temporary residence card;
- for foreign nationals and stateless persons married to persons mentioned in sections 2–12 of Clause 4 of the present Law – a passport document and a temporary residence card;
- for foreign nationals and stateless persons who stay in Ukraine for employment purposes – a passport document and a temporary residence card;
- for foreign nationals and stateless persons who stay in Ukraine for purposes of participation in international technical assistance projects – a passport document and a temporary residence card;
- for foreign nationals and stateless persons who stay in Ukraine for purposes of participation in activities pursued by religious organisations – a passport document and a temporary residence card;
- for foreign nationals and stateless persons who stay in Ukraine for purposes of participation in activities pursued by branch offices, departments, representative offices, and other structural units of public (non-governmental) organisations of foreign states – a passport document and a temporary residence card;
- for foreign nationals and stateless persons employed by representative offices of foreign business entities in Ukraine – a passport document and a temporary residence card;
- for foreign nationals and stateless persons employed by branch offices or representative offices of foreign banks in the territory of Ukraine – a passport document and a temporary residence card;
- for foreign nationals and stateless persons who stay in Ukraine for purposes of cultural, scientific (academic), educational activities pursued on the grounds and in the manner prescribed by the international treaties of Ukraine or special programmes, as well as foreign nationals and stateless persons who stay in Ukraine for purposes of participation in international and regional volunteer programs or participation in the activities of volunteer organisations duly registered in Ukraine – a passport document and a temporary residence card;
- for foreign nationals and stateless persons employed as correspondents or representatives of foreign mass media in the territory of Ukraine – a passport document and a temporary residence card;
- for foreign nationals and stateless persons studying in Ukrainian educational institutions for a minimum of one year – a passport document and a temporary residence card;
- for foreign nationals who are citizens of the states entitled to enter Ukraine without a visa under the laws of Ukraine or an international treaty of Ukraine – a passport document or another document as stipulated by the international treaty of Ukraine;
- for foreign nationals who are citizens of the states which have concluded agreements on local border traffic – documents entitling to cross the state border within the local border traffic, issued by diplomatic missions and consular offices in Ukraine in compliance with the procedure stipulated by the Ministry of Foreign Affairs of Ukraine.
- Employees of diplomatic missions, consular offices, representative offices of international organisations, and state missions at international organisations with headquarters in Ukraine who are accredited by the Ministry of Foreign Affairs of Ukraine and enjoy diplomatic privileges and immunities according to the statute documents of such organisations or relevant international treaties of Ukraine, as well as their family members, may enter Ukraine with passport documents and accreditation cards.
Clause 14 of the Law of Ukraine “On the Legal Status of Foreign Nationals and Stateless Persons”
The return of foreign nationals and stateless persons who are not allowed to enter Ukraine
- Foreign nationals and stateless persons who are not allowed to enter Ukraine, when trying to enter Ukraine at the state border crossing checkpoint, shall not cross the state border of Ukraine and shall as soon as possible be returned to the state wherefrom they have arrived or the state that has issued their passport document.
If it is not possible to immediately return a foreign national or a stateless person, they shall stay at the border crossing checkpoint of the state border of Ukraine until their return.
Such foreign nationals and stateless persons will have their passport document marked with a notice prohibiting entry to Ukraine for the term specified in the decision made pursuant to section 3 of Clause 13 of the present Law. - Foreign nationals and stateless persons, should they cross the state border of Ukraine illegally, by-passing the state border crossing checkpoints, shall be detained and, if their violation of the laws of Ukraine does not call for criminal liability, shall be returned to the country of their previous stay according to the prescribed procedure.
Such foreign nationals and stateless persons shall be forbidden to enter Ukraine for a term of three years. Information about such persons shall, in the manner prescribed by the Cabinet of Ministers of Ukraine, be entered into the database of persons who, under the laws of Ukraine, are not allowed to enter Ukraine or have their right of departure from Ukraine temporarily restricted. - Foreign nationals and stateless persons detained thereby shall have their fingerprints taken by state border protection authorities and shall, should a necessity to do so arise, have their other biometric data collected, pursuant to the law.
Clause 141 of the Law of Ukraine “On the Legal Status of Foreign Nationals and Stateless Persons”
Return of foreign nationals and stateless persons to the temporarily occupied territory
- Foreign nationals and stateless persons who have arrived to the entry/exit checkpoints from the temporarily occupied territory without the appropriate permit, shall not be allowed to proceed and shall, as soon as possible, be returned to the temporarily occupied territory wherefrom they have arrived or into the state that has issued their passport document.
If it is not possible to immediately return a foreign national or a stateless person, they shall stay at the entry/exit checkpoint until their return.
Such foreign nationals and stateless persons will have their passport document marked with a notice prohibiting entry to Ukraine for the term specified in the decision made pursuant to section 3 of Clause 13 of the present Law.
